Lustration
1. Purification of government (lustration) is a ban established by the Law of Ukraine "On Purification of Government" or by a court order for individual entities to occupy certain positions (to be in service) (hereinafter - positions) ( except elected ones) in state authorities and in local self-government bodies.
2. Purification of government (lustration) is carried out with the aim of preventing from participating in the state affairs management persons who, by their decisions, actions or inaction, conducted events (and/or contributed to their conduction) aimed at the usurpation of power by the President of Ukraine Viktor Yanukovych, undermining the foundations of national security and defense of Ukraine or illegal violation of human rights and freedoms, and is based on the principles of:
rule of law and legality;
openness, transparency and publicity;
presumption of innocence;
individual responsibility;
guaranteeing the right to protection.
3. For ten years from the date of entry into force of the Law of Ukraine "On Purification of Power", the positions in respect of which power purification (lustration) is carried out may not be held by the persons specified in parts, the first, the second, the fourth, the eighth, article 3 of the Law of Ukraine "On Purification of Power"
As well as persons who have not submitted within the time limit specified by the Law of Ukraine "On the Purification of Power", the statements provided for by the first part of Article 4 of the Law of Ukraine "On the Purification of Power".
4. The persons specified in parts three, five - seven of Article 3 of the Law of Ukraine "On Purification of Power" cannot hold positions in respect of which power purification (lustration) is carried out within five years from the date of entry into force of the relevant court decision .
5. The prohibition provided for by the third or fourth part of this article can be applied to a person only once.
6. The application to a person of the ban provided for in part three of this article is not a reason for refusing to apply the ban provided for in part four of this article, if there are grounds and in the manner specified by the Law of Ukraine "On Purification of Power".
7. The prohibition provided for in parts three and four of this article does not apply to persons specified in parts two to four of article 3 of the Law of Ukraine "On Purification of Power" who are recognized as participants in hostilities during the anti-terrorist operation in the east of Ukraine in accordance with the procedure established by law .
8. Decisions, actions or inaction of subjects of power in the implementation of the Law of Ukraine "On Purification of Power" are challenged in court.
